Who it binds

Business operators (Pelaku Usaha Pangan) making processed food domestically, or importing it, for trade in retail packaging — except certain processed-food products made by micro and small enterprises (Pasal 91(2)).

What it requires

Pasal 91's original 2012 text is no longer in force: Undang-Undang Nomor 6 Tahun 2023 (the Cipta Kerja omnibus law), Pasal 64 angka 13, replaced it. Under the current text, Pasal 91(1) requires a business operator to hold Perizinan Berusaha (business licensing) from the central or regional government, according to its authority, for safety/quality/nutrition oversight of processed food made domestically or imported for retail-packaged trade — Pasal 91(2) exempts certain processed-food products made by micro and small enterprises. Cipta Kerja also added Pasal 91A, setting administrative sanctions for violation: written warning, fine, temporary suspension, withdrawal of the product from circulation, compensation, and/or revocation of the Perizinan Berusaha. Separately, BPOM (the food and drug oversight agency) runs a public product registry, Cek BPOM, that lists 248,581 processed-food entries as of 2026-08-21 — that registry's own existence is a distinct, separately-sourced fact and no link between it and this specific licensing duty is asserted here.
